This privacy notice (“notice”) aims to demonstrate the commitment of the

Association Vale Institute of Technology, a non-profit association, in accordance with Brazilian law, headquartered at Avenida das Américas, 700, Bloco 8, Loja 218, Barra da Tijuca, Rio de Janeiro – RJ, CEP 22.640-100, in the city of Rio de Janeiro, State of Rio de Janeiro, registered with the CNPJ under No. 12.308.301/0001-66. (“ITV” or “We”), 

to your privacy and protection of your data, clearly and in accordance with current laws.

 

The protection of privacy and personal data reflects ITV’s values, and this notice aims to reaffirm our commitment to security and transparency in handling such Data.

 

The purpose of this notice is to clarify how ITV handles your personal data, in this case, you, during the provision of services or access to our environments, whether physical or digital, especially through the website (https://www.itv.org/) and its subdomains or linked domains, together referred to as “our environments”.

 

This notice applies to all our students, parents, visitors, and anyone else who accesses our environments.

If you are under 12 (twelve) years of age, we kindly ask that you do not register or provide data in any of our environments without the authorization and supervision of your parents or legal guardians.

We are always seeking to provide you with the most efficient services and features possible, by constantly updating them for this purpose. Therefore, this notice may be adjusted at any time, and you should check it whenever possible.

What data is collected?

ITV collects personal data when you submit it or provide it to us through our environments, such as, but not limited to, to enroll in courses, entrance exams, and other events offered by us, and this personal data is handled in accordance with current laws.

 

The list of collected data may include, but is not limited to:

(i) identification data, such as name, address and CPF;

(ii) contact data, such as email address and telephone number;

(iii) financial data, such as bank account and card data;

(iv) navigation data, such as cookies, IP address and internal circuit images, as well as other data that may be necessary to perform our services, which may vary according to the relationship between ITV and You.

 

Personal data is collected among other purposes, especially to: 

 

  • Identify you in our environments, such as for accessing certain areas of our website and possible subdomains, visiting our facilities, or using our services.
  • Fulfill the obligations arising from the use of our services according to contractually established obligations, such as the provision of educational services.
  • Allow the selection of candidates as a result of entrance exams and evaluations, as well as the possibility of scholarships.
  • Enable credit protection and collection procedures linked to the provision of services.
  • Allow the issuing of documents, declarations, diplomas, school records, among others related to the provision of services by us.
  • Send updates of our events, institutional and/or academic news, research, and course and product announcements, when authorized.
  • Protect you by performing access fraud prevention and associated risks, and compliance with legal and regulatory obligations.
  • Comply with legal obligations of record keeping established by the Internet Civil Rights Framework – Law 12,965/2014.
  • Maintain secure access to our environments.

 

Some of our services rely on the data provided above, therefore you are solely responsible for the accuracy, truthfulness, or lack thereof of the data you provide. If you choose not to provide some of this data, we may be unable to provide all or part of our services to you. 

 

Likewise, we are not obliged to handle any of your data if there is reason to believe that such handling would cause us to violate any applicable law, or if you are using our environments for any illegal, unlawful, or unethical purpose. 

How is personal data shared?

ITV may, subject to applicable legal grounds, share some of the personal data collected in certain situations, as exemplified below:

 

  • With suppliers, if necessary for the provision of services. For this sharing, rights and duties are established between the parties, in order to ensure compliance with applicable laws.
  • With competent judicial, administrative, or governmental authorities, whenever there is a legal determination, request, requisition, court order with the purpose of answering questions or investigations or the need to defend interests.

What are your rights with respect to your personal data?

You may, among other rights under applicable law, request, for example, confirmation of the existence of personal data Handling, in addition to the display or rectification of your personal data and its portability to another controller indicated by you, as applicable, through our environments.

 

You may also:

 

(i) Request a limitation on the use of your personal data;

(ii) Express your opposition and/or revoke consent to the use of your personal data; or

(iii) Request anonymization, blocking or deletion of your personal data that has been collected in connection with the use of our environments.

Should you request the deletion of your personal data, it may occur that the data needs to be kept regardless of the request for deletion, pursuant to applicable laws, to comply with a legal or regulatory obligation. 

How the protection of personal data is ensured and how you can help to protect it

Personal data is protected against unauthorized access, unlawful handling, or disclosure, as well as accidental loss, modification, or destruction. This applies regardless of whether such data is handled in an electronic environment or in a physical environment.

 

ITV has appropriate technical and organizational measures in place to protect data, such as information classification, backup and restoration of data, and identity and access management. These measures are based on security and data protection risk analysis.

 

In the event that Personal data is deleted, the process is conducted in a secure manner, in line with reasonable technical measures, to ensure that deleted personal data cannot be recovered.

 

Internally, access to and handling of personal data are guided by the principles of proportionality, necessity, and relevance to our business objectives, in addition to our commitment to maintaining the confidentiality of the information in our structure and preserving your privacy under the terms of this notice.

 

When you use our environments, you may be led via links to other portals or platforms that may collect information about you and have their own data handling policy. It is up to you to read the privacy and data handling policies of such portals or platforms outside our environment and it is your responsibility to accept or reject it. ITV is not responsible for the privacy and data handling Policies of third parties nor for the content of any websites or services linked to environments other than our own.

 

To optimize and improve our communication, when we send you an email, we may receive a notification when it is opened, provided that this possibility is available. It is important that you are kept aware that the e-mails are sent only by domains belonging to ITV.

For how long is data retained?

All personal data collected will be handled and kept as long as necessary for the fulfillment of its purposes, or until the rights of opposition or revocation of consent are enforced, when applicable.

 

Data may also be kept in our files in compliance with and in observance of the time limits defined in the legal system concerned, whether for the fulfillment of a legal or regulatory obligation or for the regular exercise of rights. This justifies, therefore, the maintenance of the personal data in our databases, under the same security and protection mechanisms mentioned above.

 

Data collected will be stored on our servers located in or outside the country, as well as in a cloud computing environment, which may require a transfer and/or processing of this Data outside Brazil.

Other provisions

Should any point of this notice be considered inapplicable by the National Data Protection Authority or by a competent administrative or judicial authority, the other conditions will remain in full force and effect.

 

Each and every communication we send to you through our channels is valid, effective, and sufficient for the disclosure of any matter related to the services we provide, to your data, as well as any other matter we deem relevant for the provision of our services and functionalities.

For the purposes of this notice, the following definitions and descriptions should be considered for better understanding:

 

(i) Anonymization: Use of reasonable and available technical means at the time of handling, whereby a data loses the possibility of association, directly or indirectly, with an individual.

 

(ii) Cookies: Small files sent by our environments, saved on your devices, which store your preferences and little other information, with the purpose of personalizing your browsing according to your profile.

 

(iii) Cloud Computing: A service virtualization technology built from interconnecting more than one server through a common information network (e.g., the Internet).

 

(iv) Data: Any information entered, handled or transmitted through our environments.

 

(v) Personal Data: Data related to an identified or identifiable natural person.

 

(vi) Data Protection Officer -DPO: Person appointed by ITV to function as a communication channel between the controller, the data subjects, and the National Data Protection Authority (ANPD).

 

(vii) Session ID: User session identification when accessing our environments.

 

(viii) IP: Abbreviation for Internet Protocol. It is an alphanumeric string that identifies users’ devices on the Internet.

 

(vx) Handling: Any operation conducted with personal data, such as those related to collection, production, receipt, classification, use, access, reproduction, transmission, distribution, processing, filing, storage, deletion, evaluation or control of the information, modification, communication, transfer, dissemination, or extraction.
